Partner Visa 

Allows the fiance or fiancee, partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia.

If you are engaged, in a de-facto relationship or married to an Australian citizen, permanent resident or eligible New Zealand resident, you can apply to become Australian permanent resident using the below partner visa pathway.

Prospective Marriage visa(Subclass 300)

This visa lets you come to Australia to marry your prospective spouse and then apply for a Partner visa.

With this visa you can

  • stay in Australia for 9 months from date of grant of visa
  • work in Australia
  • study in Australia at your own expense

  • You must be outside Australia when you apply and when department of home affairs ( immigration office) makes a decision on your application.

 

Partner visa for couples ( married, de-facto) living in Australia ( subclass 820 & 801)

Partner visa (Temporary)

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily.

Getting this visa is the first step towards a permanent Partner visa (subclass 801).

  • This leads directly to the permanent Partner visa
  • You must be in Australia when you apply

Subclass 801
Partner visa (Permanent)

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia permanently.

It is usually only for people who currently hold a temporary Partner visa (subclass 820).

  • You must hold a temporary Partner visa (subclass 820)

 

Partner visa for couples ( married, de-facto) living outside Australia ( subclass 309 & 100)

Subclass 309
Partner (Provisional) visa

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily.

Getting this visa is the first step towards a permanent Partner visa (subclass 100).

Subclass 100
Partner (Migrant) visa

The visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen, live in Australia permanently.

It is usually granted to people who hold a temporary Partner visa (subclass 309).

  • You must hold a temporary Partner visa (subclass 309)
